Trump trial live: David Pecker returns to testify on ‘catch-and-kill’ payouts - The Independent

Donald Trump meets New Yorkers before resuming hush money trial

Donald Trump made a surprise campaign stop at a construction site in New York early on Thursday morning en route to day seven of his hush money trial, where the jury is hearing further testimony from a former tabloid mogul who detailed the “catch-and-kill” scheme central to the case.

Former National Enquirer publisher David Pecker testified on Tuesday about his agreement with Mr Trump and former attorney Michael Cohen to “kill” stories about the defendant’s alleged affairs.

New York Justice Juan Merchan may also rule today on whether Mr Trump should be held in contempt and fined $10,000 for allegedly violating a trial gag order by posting about witnesses and jurors on Truth Social.

Elsewhere, 11 local Republicans and several key Trump allies have been indicted in Arizona for allegedly joining a failed “fake elector” plot during the aftermath of the 2020 election to falsely certify Mr Trump’s victory in the state.

And, in Washington DC, attorneys for the former president will today deliver oral arguments in front of the US Supreme Court in support of his “presidential immunity” defence against prosecution in what promises to be a landmark hearing.

Alex Woodward is providing live updates from the courthouse in Manhattan.

We’re hearing about the Access Hollywood tape. Reminder: Jurors aren’t allowed to watch it, but attorneys can describe the contents.

It appears that Trump’s eyes are closed.

He’s moving around in his chair and bending his head to hear, so it looks as if he’s still listening.

Pecker says Cohen called him to take down a post on Radar Online showing Trump at the Playboy mansion. Trump was “very upset”.

We see an email from Dylan Howard on 8 October 2016 (one month before Election Day) noting that the Radar Online post was posted in 2008, before AMI owned it.

“Nevertheless, I have deleted the text story completely. It no longer exists,” Howard wrote.

The post titled was “Donald Trump, Playboy Man”

Pecker says he has never known Trump to use email.

A former tabloid publisher said he agreed to spend tens of thousands of dollars to buy politically compromising stories about Donald Trump with the assurance that “the boss will take care of it.”

“Don’t worry about it. I’m your friend. The boss will take care of it,” Cohen told him, according to Mr Pecker.

Court resumes

Court is back in session after a short break.

Alex Woodward continues to report from the courtroom for The Independent:

We’re hearing text messages from Dylan Howard suggesting that Trump would pardon him for election fraud. The judge is going to think about whether they can be included.

“The fact that they came off an AMI device is to me of no consequence,” he says.

Pecker and the jury aren’t present.

Steinglass says the prosecution has two-three hours left with Pecker. That’ll take them through the day, most likely.

Pecker returns to the stand and the jury is brought back in.

Trump vows to beat Biden in New York

Donald Trump vowed to beat President Joe Biden in the 2024 election in New York as he made a surprise campaign stop at a construction site in Manhattan early on Thursday morning – on a day when testimony resumes in his hush money trial and the US Supreme Court hears arguments in his “presidential immunity” case.

“We’re going to make a play for New York,” Mr Trump told reporters at the event.

When Pecker told Cohen that the deal was off, after his conversations with counsel about the transaction, “he was very, very angry, very upset, screaming basically at me. I said I’m not going forward with this agreement.”

“Michael Cohen said the boss will be very angry with you. I said I’m sorry, I’m not going forward, the deal is off,” Pecker said. “He said I can’t believe it. I’m the lawyer, I’m your friend.”

Steinglass: “Did AMI ever get reimbursed for the money it spent to acquire the exclusive rights to Ms McDougal’s story?”

“No, it never did.”

The court is taking a short break.

Trump has been pretty relaxed, he seems to be getting used to this, and he’s been carefully watching Pecker’s testimony while only slightly slouched in his chair.

We see an invoice from Investor Advisory Service Inc to Cohen’s shell company Resolution Consultants LLC for $125,000 on 21 September 2016.

“When I spoke to Michal Cohen, he said he was creating a company to receive the lifetime rights and that would reimburse, paid, that $125,000,” Pecker says.

The invoice is for the “agreed upon ‘flat fee’ for advisory services.”

Under questioning from Steinglass, Pecker admits it was not for that at all.

“It was for the lifetime rights to the Karen McDougal story.”

In September 2016, Cohen told Pecker that Trump wanted to acquire the rights to McDougal’s story.

Trump also “wanted all of the content that the National Enquirer had or developed and retained on Mr Trump.”

“I told Michael that these are old files, boxes, that were in Florida. The company has been moved to New York City,” Pecker said. “He insisted he wanted those boxes, wanted that content.”

“Cohen said, ‘the boss said if I get hit by a bus … he wouldn’t want someone else to publish those stories’.”

UN rights chief 'horrified' by mass grave reports at Gaza hospitals - BBC

Palestinian civil defence workers dig mounds of earth in the grounds of Nasser hospital in Khan Younis, in the southern Gaza Strip (21 April 2024)Reuters

The UN's human rights chief has said he is "horrified" by the destruction of Gaza's Nasser and al-Shifa hospitals and the reports of "mass graves" being found at the sites after Israeli raids.

Volker Türk called for independent investigations into the deaths.

Palestinian officials said they had exhumed 283 bodies at Nasser, some with their hands tied. It is not clear how they died or when they were buried.

Israel's military said claims that it buried bodies there were "baseless".

But it did say that during a two-week operation at the hospital in the city of Khan Younis in February, troops "examined" bodies buried by Palestinians "in places where intelligence indicated the possible presence of hostages".

Ten hostages who have now been released have said that they were held at Nasser hospital for long periods during their captivity.

Prior to the Israeli operation at Nasser, staff there had said they were being forced to bury bodies in the hospital's courtyard because nearby fighting prevented access to cemeteries. There were similar reports from al-Shifa before the first Israeli raid on the hospital took place in November.

The Israeli military has said it has raided a number of hospitals in Gaza during the war because Hamas fighters have been operating inside them - a claim Hamas and medical officials have denied.

The war began when Hamas gunmen carried out an unprecedented cross-border attack on southern Israel on 7 October, killing about 1,200 people - mostly civilians - and taking 253 others back to Gaza as hostages.

More than 34,180 people - most of them children and women - have been killed in Gaza since then, the territory's Hamas-run health ministry says.

A spokeswoman for the UN Human Rights Office said it was currently working on corroborating reports from Palestinian officials that 283 bodies had been found in Nasser hospital's grounds, including 42 which had been identified.

"Victims had reportedly been buried deep in the ground and covered with waste," Ravina Shamdasani told reporters in Geneva.

"Among the deceased were allegedly older people, women and wounded, while others... were found with their hands tied and stripped of their clothes."

Mr Türk called for independent, effective and transparent investigations into the deaths, adding: "Given the prevailing climate of impunity, this should include international investigators."

"Hospitals are entitled to very special protection under international humanitarian law. And the intentional killing of civilians, detainees, and others who are hors de combat [not participating in hostilities] is a war crime."

The US state department also said the reports were "incredibly troubling".

On Monday, a spokesman for the Hamas-run Civil Defense force told BBC Arabic's Gaza Today programme that it had received reports from local Palestinians that the bodies of a "large number" of people who had been killed during the war and buried in a makeshift cemetery in the hospital's courtyard were moved to another location during the Israeli raid.

"After research and investigation, we learned that the occupation [Israeli] army had established a mass grave, pulled out the bodies that were in Nasser hospital, and buried them in this mass grave," Mahmoud Basal said.

Gaza Today also spoke to a man who said he was searching there for the bodies of two male relatives which he alleged had been taken by Israeli troops during Israel's recently concluded offensive in Khan Younis.

"After I had buried them in an apartment, the [Israelis] came and moved their bodies," he said. "Every day we search for their bodies, but we fail to find them."

Hamas has alleged that the bodies include people "executed in cold blood" by Israeli forces, without providing evidence.

The Israel Defense Forces (IDF) said in a statement on Tuesday: "The claim that the IDF buried Palestinian bodies is baseless and unfounded."

"During the IDF's operation in the area of Nasser Hospital, in accordance to the effort to locate hostages and missing persons, corpses buried by Palestinians in the area of Nasser hospital were examined.

"The examination was conducted in a careful manner and exclusively in places where intelligence indicated the possible presence of hostages. The examination was carried out respectfully while maintaining the dignity of the deceased. Bodies examined, which did not belong to Israeli hostages, were returned to their place."

The IDF said that its forces had detained "about 200 terrorists who were in the hospital" during the raid, and that they found ammunition as well as unused medicines intended for Israeli hostages.

It also insisted that the raid was carried out "in a targeted manner and without harming the hospital, the patients and the medical staff".

However, three medical staff told the BBC last month that they were humiliated, beaten, doused with cold water, and forced to kneel for hours after being detained during the raid.

Medics who remained at Nasser after the Israeli takeover said they were unable to care for patients and that 13 died because of conditions there, including a lack of water, electricity and other supplies.

On 1 April, Israeli troops withdrew from al-Shifa hospital, which is in Gaza City, following what the IDF said was another "precise" operation carried out in response to intelligence that Hamas had regrouped there.

The IDF said at the time that 200 "terrorists" were killed in and around the hospital during the two-week raid. More than 500 others were detained, and weapons and intelligence were found "throughout the hospital", it added.

After a mission gained access to the facility five days later, the World Health Organization (WHO) said al-Shifa was "now an empty shell", with most of the buildings extensively damaged or destroyed, and the majority of equipment unusable or reduced to ashes.

The IDF also said it had avoided harm to patients at al-Shifa. But the WHO cited the acting hospital director as saying patients were held in abysmal conditions during the siege, and that at least 20 patients reportedly died due to a lack of access to care and limited movement authorised for medics.

Spokeswoman Ms Shamdasani said reports seen by the UN human rights office suggested that a total of 30 bodies were buried in the two graves and that 12 of them had been identified so far.

"There are reports that the hands of some of these bodies were also tied," she said, adding that "many more" people could have been killed than the 200 reported by the IDF.

Gaza's civil defence spokesman told CNN on 9 April that 381 bodies had been recovered from the vicinity of al-Shifa, but that the figure did not include people buried in the hospital's grounds.

The UN human rights chief also deplored as "beyond warfare" a series of Israeli strikes on the southern city of Rafah in the past few days, which he said had killed mostly women and children.

The strikes included one on Saturday night, after which a premature baby was delivered from the womb of her pregnant mother, who was killed along with her husband and other daughter.

Mr Türk also again warned against a full-scale Israeli ground assault on Rafah, where 1.5 million displaced civilians are sheltering, saying it would lead to further breaches of international humanitarian law and human rights law.

In response, the IDF said it was "operating to dismantle Hamas military and administrative capabilities".

"In stark contrast to Hamas' intentional attacks on Israeli men, women and children, the IDF follows international law and takes feasible precautions to mitigate civilian harm," it added.

Campus pro-Palestine protests live: More arrests overnight as tension escalates - The Independent

Pro-Palestine protesters occupy Columbia university lawn

New York Police Department (NYPD) officers arrested students staging pro-Palestine encampment protests at New York University (NYU) last night after leaders in the university said the group behaved in a disorderly and disruptive manner.

The arrests come after approximately 100 Columbia University students were arrested for conducting protests against the school’s financial ties to Israel amid the Gaza war.

But tensions on the university’s campus have been mounting as some Jewish students say they’ve faced antisemitic harassment in recent days. The university announced all classes will go hybrid, partially in-person and partially online, for the rest of the semester.

Robert Kraft, a major Columbia University donor, said he was pulling funding to the school because he is “no longer confident that Columbia can protect its students and staff.”

Across the United States, students at other colleges and universities have begun protests in solidarity with Columbia University students including Yale University, MIT, Tufts University, University of Michigan and University of California, Berkeley.

Cal Poly Humboldt closes campus amid ‘dangerous’ situation

Pro-Palestinian protests at the California Polytechnic State University (Cal Poly), Humboldt have escalated to the point of the school closing campus on Tuesday.

On Monday, approximately 100 students convened near Siemens Hall in protest of the Gaza war and the university’s financial ties to Israel. Later in the afternoon, police were called to the scene due to alleged fights that broke out, according to a local report.

By 5pm PST, students began occupying Siemens Hall. Protestors barricaded themselves inside the building with furniture, blocking entrances and elevators with tents. They also, allegedly, vandalized parts of the building.

Classes were canceled and the courses that were in progress were evacuated.

In a notice to faculty, students and staff, CalPoly Humboldt said that campus was closed and people were “advised to avoid the area of the building, as it is a dangerous and volatile situation.”

“The University is deeply concerned about the safety of the protestors who have barricaded themselves inside the building. The University is urgently asking that the protestors listen to directives from law enforcement that have responded and to peacefully leave the building.”

When protestors refused to leave voluntarily, the building was shut off and police were called in. Around 11pm PST, law enforcement officials arrested students.

Donald Trump calls college and university protests ‘a disgrace’ and blames Biden

Former president Donald Trump called the pro-Palestinian protests at colleges and universities “a disgrace” and blamed President Joe Biden for igniting them with “the wrong signal.”

Before heading into Manhattan Criminal Court for his hush-money trial, Mr Trump held a brief press briefing outside of the courtroom, as he does every day.

“What’s going on at the college level and the colleges Columbia, NYU University, this is a disgrace,” Mr Trump said. “And it’s really on Biden. He has the wrong signal, he has the wrong tone, he’s got the wrong words.”

Mr Trump claimed Mr Biden was “no friend of Israel” nor a “friend of the Arab world”.

“But what he’s done to Israel is abandoned them, and he’s tried to be as nice as he can to the other side – call it the Arab world. But that’s not working either because they get him and he’s an incompetent man. Peace will never happen with a guy like this.”

Columbia moves classes online for the rest of the semester

Columbia University announced on Monday they will be moving the rest of the semester’s classes hybrid as the campus faces growing tensions.

“ Safety is our highest priority as we strive to support our students’ learning and all the required academic operations,” an announcement from the university said.

So long as classroom technology permits, classes on the school’s main campus will be hybrid – meaning classes will be offered the opportunity to move online or in-person.

Arts and practice-based programmes will be in-person with “generous accommodations”. Classes in the medical centre or Manhattanville campus will be in-person with accommodations based on religious reasons or approved disability accommodations.

UC Berkeley students begin sit-in

Monday afternoon, students at the University of California, Berkeley began a sit-in on the steps of Sproul Hall to protest the Gaza war and the school’s financial ties to Israel – as Columbia University students take the national stage for their protest encampments.

Students held signs saying, “UC you have blood on your hands” and “Let Gaza live.”

A spokesperson for the university told Berkeley Side that the school has no plans to change its investment policies and practices.

“With three weeks left in the semester, Berkeley is prioritizing students’ academic interests,” Dan Mogulof said. “We will take the steps necessary to ensure the protest does not disrupt the university’s operations.”

Robert Kraft pulls funding to Columbia

Robert Kraft, the CEO of the Kraft Group, announced he will pull funding to Columbia University until “corrective action” is taken to reduce antisemitic harassment on campus amid protests over the Gaza war.

In a post from the Foundation to Combat Antisemitism, a nonprofit organisation founded by Mr Kraft, the American businessman said that he is “no longer confident that Columbia can protect its students and staff” and is, “not comfortable supporting the university until corrective action is taken.”

Mr Kraft is an alumna and a longtime donor to the school. His funding helped establish The Kraft Center for Jewish Student Life.

NYU requested police presence after student ‘disorderly’ conduct

Dozens of students were arrested on New York University’s (NYU) campus last night after leaders at the university told police that students were “trespassing” and behaving in a “disorderly, disruptive and antagonizing” manner.

NYPD Commissioner Kaz Daughtry posted a photo on X revealing an email NYU leaders sent to the NYPD asking for police pressence on campus.

“ Following negotiations this morning, additional protestors breached our barriers in violation of our clear instructions and we witnessed disorderly, disruptive and antagonizing behavior that has interfered with the safety and security of our community,” an email from an NYU leader said.

“At this point we consider all protestors occupying Gould Plaza to be trespassers and we would like the NYPD to clear the area and take action to remove the protestors.”

Two Malaysian navy helicopters collided in mid-air as they flew in formation during a rehearsal for a military parade, killing all 10 crew on board.

One of the aircraft clipped the rotor of the other before the two crashed into the ground, footage published on local media showed.

The incident took place at 09:30 local time (02:30 BST) in the Malaysian town of Lumut, which is home to a Royal Malaysian Navy base.

There are no known survivors.

"All victims were confirmed dead on site and the remains were sent to the [Lumut] Military Hospital for identification," said the Royal Malaysian Navy.

It added that it would form a committee to investigate the cause of the incident.

One of the helicopters, a HOM M503-3 with seven people on board, is believed to have crashed onto a running track.

The other, a Fennec M502-6 carrying the other three victims, crashed into a swimming pool nearby.

The state's fire and rescue department said it was alerted to the incident at 09:50 local time (01:50 GMT).

Malaysia's Prime Minister Anwar Ibrahim said in a post on X, formerly known as Twitter, that "the nation mourns the heart-wrenching and soul-wrenching tragedy".

"Condolences to all the families of the victims and prayers for strength to face this calamity," he said.
